1. Acceptance of these terms
These Terms of Service ("Terms") are an agreement between you and Menexus GmbH ("we", "us", "our") governing your use of the Skyzai app and apu.bot (together, the "Service"). By creating an account or using either app, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Service.
2. The service
Skyzai is a cross-platform app combining a crypto wallet (Hedera Hashgraph and EVM chains), an escrow/booking system for businesses, AI features, event ticketing, and a Nostr-based social network. apu.bot is a separate, voice-and-text AI note-taking web app that shares your Skyzai account: you talk or type, and it organises what you said into notes, tasks and categories, with optional reminders and answers drawn from your own Skyzai data when you've opted in to that.
We may add, change, or remove features at any time, and features described here may not all be available on every platform.
3. Accounts and eligibility
You must be at least 16 years old to use the Service. You're responsible for keeping your login credentials and any device-stored key material secure, and for everything that happens under your account. Tell us right away if you believe your account has been compromised.
4. Acceptable use
You agree not to:
- Use the Service for anything illegal, fraudulent, or to launder money, or to upload or generate unlawful content;
- Impersonate another person or business, or misrepresent your affiliation with anyone;
- Attempt to break, bypass or probe the Service's security controls, rate limits or fair-use limits (§6), or access another user's data or account;
- Misuse apu.bot's AI features — including prompting it to act outside its intended note-taking/organising purpose, or automating requests to it at a volume no real person would send by hand;
- Upload content you don't have the rights to, or that infringes someone else's rights;
- Use the Service to harass, threaten, or endanger others, including minors;
- Otherwise interfere with or disrupt the Service's infrastructure.
We may suspend or terminate accounts that violate this section.
5. AI features (apu.bot)
apu.bot uses a third-party AI model (Groq — see our Privacy Policy) to turn what you say into notes and tasks, and to answer questions using your own Skyzai data when you've opted in to that. AI output can be wrong, incomplete, or misfiled — you're responsible for reviewing and correcting anything the AI saves on your behalf, and for how you use reminders and notes it creates, especially anything you'll rely on (dates, amounts, commitments). apu.bot is a note-taking tool, not professional advice of any kind.
6. Fair-use limits
To keep apu.bot available and responsive for everyone, we apply daily limits to the number of chat messages and voice recordings an account can send, on top of shorter per-minute limits. These exist to prevent abuse and keep shared AI capacity fair across all users, not to restrict normal use — if you hit one, you'll see a clear message and can try again shortly.
7. Wallet, crypto and payments
Skyzai lets you hold and move crypto assets on the Hedera and EVM networks. Blockchain transactions are irreversible once confirmed. You alone are responsible for your private keys — we never hold them, never sign transactions on your behalf, and cannot recover funds sent to the wrong address or lost keys. Nothing in the Service is investment, legal, or tax advice, and crypto asset values can be highly volatile. Use of any escrow, booking, or payment feature is also subject to the specific terms shown to you at the time, where applicable.
8. Nostr and public content
Your Skyzai profile and posts are also published to the public Nostr network, as described in our Privacy Policy. Content you publish there is public by design, is served by relays we don't control, and cannot be reliably deleted once broadcast. You're responsible for what you choose to post there.
9. Business accounts and verification
Business accounts may go through identity/business verification (KYC/KYB) before certain features unlock. You confirm that information and documents you submit are accurate and that you're authorized to submit them on behalf of the business. We may refuse, suspend, or revoke business features based on the outcome of that verification.
10. Intellectual property
The Service, including its design, branding, and underlying software, belongs to Menexus GmbH or our licensors. You keep ownership of content you create (profile content, posts, notes), and you grant us the license needed to store, process, and display it back to you as part of running the Service.
11. Termination and account deletion
You can delete your account at any time from inside either app (Skyzai: Settings → About → Delete Account; apu.bot: Settings menu → Delete account) — see our Privacy Policy for exactly what that removes. We may suspend or terminate your access if you violate these Terms, and we'll make reasonable efforts to notify you when we do, except where legally prevented from doing so or where notice could compromise an investigation.
12. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, to the extent the law allows. We don't guarantee the Service will be uninterrupted or error-free, and AI output can be wrong — see §5. Price data and on-chain data shown to you may also be delayed or inaccurate; verify anything important directly on-chain before relying on it.
13. Limitation of liability
To the extent the law allows, our liability to you for anything arising from your use of the Service is limited, and we're not liable for indirect or consequential losses (such as lost profits or lost data) arising from your use of the Service. Nothing in these Terms limits liability that cannot be limited under applicable law.
14. Governing law
These Terms are governed by the laws of Switzerland, without regard to its conflict-of-laws principles.
15. Changes to these terms
We'll update the "Last updated" date above when we change these Terms, and post the updated version here. If a change is significant, we'll make a reasonable effort to let you know in-app before it takes effect. Continuing to use the Service after a change takes effect means you accept the updated Terms.
